Report Infringement

If you believe that any content posted on Organic Apps Inc.’s (“Organic Apps”) Websites and/or Apps, or otherwise through the Services (as defined in the Terms of Service) infringes your copyright or other intellectual property right, then you may send to us a written communication that includes the following (please consult your legal counsel or see Section 512(c)(3) of the US Copyright Act to confirm these requirements with respect to copyright claims):

  • Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of Copyrighted Work: Identification of any copyrighted work claimed to have been infringed.
  • Location on Site: Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material (including URLs to access the material).
  • Contact Information: Information reasonably sufficient to permit us to contact you about your complaint, such as an address, telephone number, and, if available, an email address.
  • Good Faith Belief: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or applicable law.
  • Penalty of Perjury: A statement, sworn under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter Notice

If you believe that any content posted on the Website and/or Apps, or otherwise through the Services (as defined in the Terms of Service) was taken down for infringement in error, you may send us a DMCA counter notification letter as defined in 17 USC 512(g)(3), containing to the following:

  • Signature: The counter notice must include your signature. The signature can be in physical or electronic form.
  • Identify the Alleged Infringing Activity and its Location on the Site: The counter notice must identify the alleged infringing activity that is the subject of the takedown request, and identify where the infringing activity was located on the site before it was removed.
  • Contact Information: The counter notice must contain your name, address and telephone number.
  • Good Faith Belief: The counter notice must include a statement that you have a good faith belief that the infringing activity was removed or disabled as a result of mistake or misidentification.
  • Consent to be Sued in Federal Court: The counter notice must include a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which you are located and will accept service of process from the person who sent the DMCA takedown notice or if you are located outside of the United States, you consent to the jurisdiction of any United States federal district court where Organic Apps is located and will accept service of process from the person who provided the takedown request or their agent.
